By creating an account, accessing, or using Spit Your Truth ("the Platform"), you acknowledge that you have read, understood, and agree to be bound by these Terms of Use and our Privacy Policy. If you do not agree to these terms, please do not use the Platform.
2. Eligibility
You must be at least 13 years old to use the Platform. If you are under 18, you represent that you have your parent or guardian's permission to use the Platform. By using the Platform, you represent and warrant that you meet these eligibility requirements.
3. User Accounts
- You are responsible for maintaining the confidentiality of your account credentials
- You agree to provide accurate and complete information when creating your account
- You are solely responsible for all activities that occur under your account
- You must notify us immediately of any unauthorized use of your account
4. User Content
Ownership: You retain all ownership rights to the original content you post on the Platform, including poems, videos, comments, and other creative works ("User Content").
License Grant: By posting User Content on the Platform, you grant Spit Your Truth a non-exclusive, worldwide, royalty-free, sublicensable license to use, reproduce, modify, adapt, publish, translate, distribute, and display such content in connection with operating and promoting the Platform. This license allows us to display your content to other users, share it on social media, and include it in promotional materials.
Representations: You represent and warrant that you own or have the necessary rights to post your User Content and that it does not violate any third party's intellectual property rights, privacy rights, or other legal rights.
Removal: You may delete your User Content at any time. We may also remove User Content that violates these Terms or our Community Guidelines.
5. Community Guidelines
All users must comply with our Community Guidelines, which prohibit:
- Hate speech and discrimination
- Harassment and bullying
- Threats and violence
- Sexually explicit or pornographic content
- Illegal activity
- Spam and misinformation
Violation of these guidelines may result in content removal, account suspension, or permanent ban.
6. Intellectual Property
The Platform and its original content (excluding User Content), features, and functionality are owned by Spit Your Truth and are protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, or create derivative works based on the Platform without our express permission.
7. Termination
We reserve the right to suspend or terminate your account at any time for any reason, including violation of these Terms or our Community Guidelines.
You may delete your account at any time through your Profile Settings. Upon account deletion, your personal data and User Content will be permanently removed in accordance with our Privacy Policy.
8. Disclaimers
THE PLATFORM IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DO NOT GUARANTEE THAT THE PLATFORM WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE.
We are not responsible for User Content posted by other users. The views expressed in User Content do not represent our views or opinions.
9. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, SPIT YOUR TRUTH SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF THE PLATFORM.
10. Changes to Terms
We may update these Terms from time to time. We will notify you of any material changes by posting the updated Terms on the Platform. Your continued use of the Platform after such changes constitutes your acceptance of the new Terms.
